Good Labor Practices Evaluation Factor
The Maryland Department of Labor (MD Labor) and the Department of General Services (DGS) invite interested parties to participate in an online engagement session regarding establishment of new regulatory requirements implementing the Good Labor Practices Evaluation Factor under the Maryland Procurement Reform Act of 2025 (PRA) on Monday, March 16, 2026, from 10:30am-12:00pm.
Section 9 of the PRA establishes that a Good Labor Practices (“GLP”) Evaluation Factor will be used as part of the technical evaluation for certain competitive sealed proposals. Prospective offerors who wish to qualify for the GLP evaluation factor must file an affidavit agreeing to adhere to good labor practices, including among other things:
- direct employment of workers as W-2 employees,
- paying workers by check as opposed to cash,
- strictly complying with labor standards, securing a payment bond for wages, and
- disclosing violations of these obligations.
Further, the prospective offeror must provide advance notice of any contractors, and must require any contractors and subcontractors performing work under the contract to also adhere to these good labor practices.
The statute authorizes the Chief Procurement Officer and Commissioner of Labor to adopt implementing regulations to operationalize these requirements.
Purpose of the Engagement Session
This meeting aims to:
- Explain key statutory elements of Subtitle 9 of the PRA and how the State is planning to implement them.
- Present the initial regulatory draft and implementing forms developed by DGS and the Department of Labor (anticipated to be shared prior to or during the public engagement).
- Gather input from stakeholders on proposed regulatory requirements and implementing forms.
